These Terms and Conditions (“Terms and Conditions”) apply in relation to general visits to the Website and to access and use of its “Content” which is the service we explain further in the next paragraph.

Our Website provides you with comparative price information relating to the supply of gas, electricity, telecoms and broadband together with other information which may be relevant if you wish to switch your supply of gas and electricity from one energy provider to another (“Content”). We have obtained this information from the various utility providers who are identified on the Website. The Content we display is intended to give you the capability to establish the best price available to you as a consumer for utilities which you may wish to purchase from the energy providers identified.

YOUR USE OF THE WEBSITE AND OF ITS CONTENT CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. Business Energy Switch reserves the right to amend these Terms and Conditions as we see fit from time to time.

• WE CANNOT BE HELD LIABLE FOR ANY INFORMATION (WHETHER CONCERNING PRICES OR SERVICES OR OTHERWISE) PROVIDED BY THIRD PARTIES WHICH IS INCORRECT, MISLEADING OR INACCURATE.  Business Energy Switch cannot be responsible for any aspect of the process of switching utility supplier which is a matter between you and the suppliers concerned. However, Business Energy Switch shall use all reasonable endeavours to ensure that the price comparison information within the Content is accurate and up to date.

• No warranties or representations are given by Business Energy Switch or may be implied to any goods or services provided by any third party.

 

• The Content may contain technical inaccuracies or typographical errors but the liability of Business Energy Switch arising from any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

• There may also be moral rights, design rights, database rights and trade marks belonging to Business Energy Switch or certain third parties with respect to all such material inclusive of the Content. In particular, the Business Energy Switch name and logo are our trade marks. All rights are reserved.

• Business Energy Switch grants you a non-exclusive, revocable, non-transferable license to use the software on our server to access the Content whether directly from our Website or from the websites of third party providers via any hyperlinks from our Website. If you use our software to access third party websites, you acknowledge that you do soon your own behalf and that you have not appointed Business Energy Switch as your agent in any way.

 

• We grant you permission to electronically copy and print in hard copy portions of our Website solely in connection with your own private information gathering purposes.  Any other use of the Website content (including reproduction for purposes other than those noted above and alteration, modification, distribution or republication) without our prior written permission is strictly prohibited.

         You agree that you have not relied on any representation save insofar as the same has been made expressly as a representation within these Terms and Conditions.

         Our failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision unless we acknowledge and agree otherwise in writing.

10.     Severance

         If any provision of these Terms and Conditions is held by a court of competent jurisdiction or other lawful authority to be invalid or unenforceable, then such provision shall be construed as near as possible to reflect the intentions of the parties with all other provisions remaining in full force and effect.

11.     Events beyond our control

We shall not be liable to you for any breach of these Terms and Conditions or any failure to provide or delay in providing any information through this Website resulting from any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, fire, explosion or accident.

• The Website is controlled and operated by Business Energy Switch in England.  We have used our reasonable endeavours to ensure that the Website and the provision of the Content complies with the laws prevailing in England but Business Energy switch makes no representation that the materials on the Website are appropriate or available for use in jurisdictions other than England.
